§1 General Provisions
These terms and conditions (“Terms”) define the rules for using the training platform and online store available at https://adrianwiniarz.com (“Platform”, “Store”), operated by Adrian Winiarz Consulting, ul. Zawiła 45, 30-442 Kraków, Poland, NIP: 6762157708, REGON: 523764592 (“Seller” or “Service Provider”).
The Platform allows for the purchase and participation in:
a) in-person training sessions,
b) live online training (webinars),
c) e-learning courses / recordings / digital materials provided on demand,
d) additional educational materials (e.g. PDF files, presentations, quizzes, electronic certificates), as specified for each product.
Using the Platform requires reading and accepting these Terms. Placing an order constitutes acceptance of the Terms.
The Terms are made available free of charge on the Platform in a format that allows downloading, saving, and printing.
To use the Platform, an internet-enabled device and an up-to-date web browser that supports JavaScript and cookies are required. Detailed technical requirements are specified in §4, point 7.
§2 Definitions
For the purposes of these Terms, the following definitions apply:
Account – a set of resources and permissions created for the User within the Platform system, identified by an email address and password, enabling access to purchased Digital Services.
Buyer – an entity (individual, legal person, or organizational unit) making a purchase in the Store.
Consumer – a natural person making a purchase not directly related to their business or professional activity.
Entrepreneur – a natural person conducting business activity, legal person, or organizational unit making a purchase related to their business or professional activity.
Entrepreneur with Consumer Rights – a natural person conducting business activity, entering into a contract directly related to that activity, but not of a professional nature (pursuant to Article 38a of the Consumer Rights Act) – with rights defined in these Terms and applicable laws.
Service – in-person or online training provided by the Seller.
Digital Service / Digital Content – data created and delivered in digital form (e.g. recordings, e-learning materials, downloadable files) made available via the Platform.
Order – a declaration of intent made by the Buyer that directly leads to the conclusion of a Contract.
Contract – a distance contract for the sale/provision of services concluded between the Buyer and the Seller via the Platform.
Tpay – an external electronic payment provider processing online payments for the Platform.

§4 Technical Requirements and User Account
To browse the offer: a device with a supported browser (Chrome, Firefox, Edge, Safari – current supported versions) and an internet connection are required.
To participate in live webinars: a stable internet connection and speakers/headphones are required; a microphone and camera are optional (unless interaction is expected). The webinar platform may require a plugin or app installation – details are provided with each event.
To play recordings/video courses: minimum bandwidth of 2 Mbps (SD) / recommended 5 Mbps (HD). Adaptive streaming may be used.
To download materials: appropriate software to open files (e.g. PDF reader) is required.
The User bears the cost of their internet connection as per their provider’s rates.
The Seller strives to ensure continuous operation of the Platform; technical maintenance breaks may occur (§13).
Minimum system requirements (detailed configuration to be completed; recommended current versions: Windows 10+, macOS 12+, latest stable iOS/Android versions).
§5 Registration and Login
Creating an Account may be required to complete a purchase.
Registration requires providing an email address and creating a password that meets security standards.
After registration, the User will receive an email with an activation link.
The User is obligated to keep their Account information up to date in case of any changes.
Sharing login credentials with third parties is prohibited. If a product includes a multi-user or corporate license, a separate access procedure applies.
The Seller may block an Account if the User violates the law, these Terms, or generally accepted standards of conduct. Prior to blocking, the User will be requested to cease the violations—if feasible.
§6 Product and Price Information
Information about training and materials posted on the Platform constitutes an invitation to submit offers within the meaning of Article 71 of the Polish Civil Code, unless explicitly stated otherwise.
Prices are listed in Polish zloty (PLN) and include VAT.
The price visible at the time of placing an Order is the binding price.
The Seller may apply promotions, discount codes, or bundle pricing; the conditions will be published alongside the promotion.
The number of seats for in-person training and live webinars may be limited.
Time-limited access to materials (e.g., 30 days / 365 days / lifetime) is indicated in the product description. After this period, access may expire.
§7 Placing Orders and Concluding the Agreement
The Buyer selects a product (training, webinar, course), adds it to the cart, and proceeds to the Order form.
The form requires billing details:

for Consumers: first name, last name, email, and optionally a phone number;

for Entrepreneurs: company name, address, VAT ID (required for a VAT invoice), email.
Before confirming the Order, the Buyer receives a summary: service description, price, taxes, payment method, and training date if applicable.
The Order is placed by clicking the final confirmation button (e.g., “Buy and Pay”, “Order with Payment Obligation”).
The Agreement is concluded once the online payment is successfully processed.
The Seller will confirm the conclusion of the Agreement via email to the Buyer’s address.
§8 Payments
Electronic payments are processed by the operator Tpay (Krajowy Integrator Płatności S.A., pl. Władysława Andersa 3/17 floor, 61-894 Poznań, Poland).
Available payment methods include: fast online transfers, BLIK, and deferred payments (if available).
After selecting a payment method, the Buyer will be redirected to Tpay’s secure form; all payment data is processed by the payment operator.
In case of payment issues, the Buyer should contact the Seller or Tpay directly, providing the transaction number.
Invoices / Receipts:

Consumers receive purchase confirmation (electronic receipt or personal invoice).

Entrepreneurs receive a VAT invoice – based on the data provided in the Order form. The Buyer is responsible for ensuring this information is accurate.
§9 Access and Service Delivery
In-person training: details (location, date, time, agenda) are sent via email and made available in the User Account.
Live webinars: the link to the training room will be sent via email (usually 24h and 1h before the session) and made available in the Account if applicable.
On-demand courses / recordings: access is granted automatically once the payment is processed; content appears in the User Account.
Additional materials (downloadable files, certificates): provided in the “My Materials” section or sent via email.
If the Service requires a minimum number of participants, the Seller reserves the right to reschedule or cancel the training. The Buyer will receive a new proposed date or a refund.
In the event of a rescheduling caused by the Seller, the Buyer may choose to:
a) accept the new date,
b) transfer the payment to another product,
c) request a refund.
§10 Right of Withdrawal (Consumers)
IMPORTANT: Services with a fixed date (e.g., in-person training on a specific day) are treated differently from digital content provided immediately.

A consumer who has concluded a distance contract generally has 14 days to withdraw without giving any reason (Article 27 of the Consumer Rights Act), unless a statutory exception applies.

Digital content / services provided on-demand: the right of withdrawal expires if the service begins with the explicit consent of the Consumer before the end of the 14-day period and after the Consumer has been informed of the loss of the right of withdrawal. When purchasing such products, the Consumer may be required to confirm this in a declaration.

Live webinar / training on a fixed date: the right of withdrawal is generally available for 14 days, but if the event is scheduled to take place within that period and the Consumer consents to the service being delivered before the withdrawal period ends, the same rules as in point 2 apply. Specific cancellation terms may be provided in the cancellation policy.

In-person training: as per point 3, but the Seller may deduct actual costs incurred (e.g., venue reservation) in line with the information presented at the time of purchase.

The Seller will confirm receipt of the withdrawal notice on a durable medium.

The refund will be issued within 14 days of receiving the notice, using the same payment method unless the Buyer agrees to another.

A withdrawal form template is attached as Annex 1 to the Terms.
§11 Complaints (Non-Conformity with the Contract)
The Seller is liable to the Consumer for the conformity of the service with the Contract, in accordance with the Consumer Rights Act (section on digital content and services) and relevant provisions of the Civil Code.
A complaint can be submitted:

The complaint should include: Buyer’s contact details, Order number, description of the issue, and the requested action (e.g., repair, re-delivery, price reduction, or withdrawal).
The Seller will respond within 14 calendar days. Failure to respond within this period may be interpreted as acceptance of the Consumer’s complaint (in line with consumer-friendly practice – subject to legal confirmation).
If the complaint is accepted, the Seller will bring the service into conformity, provide the correct materials, offer equivalent access, or refund part or all of the price – in accordance with applicable laws.
§12 Liability and Limitations
Training materials are intended for educational and informational purposes only – they are not a substitute for individual medical, legal, financial, or other professional advice. The Seller is not liable for the consequences of using the information in a manner inconsistent with its intended purpose.
In B2B relationships, the Seller’s liability may be limited to the amount paid by the Buyer (this does not apply to damages caused intentionally).
The Seller is not liable for lack of access due to force majeure, technical interruptions, or issues on the User’s internet provider’s side (see §13).
§13 Technical Downtime, Maintenance, and Security
The Seller may temporarily suspend access to the Platform to carry out maintenance work; where possible, advance notice will be provided (e.g., via email).
In emergency situations, downtime may occur without prior notice.
User data is protected in accordance with current technical standards; however, the Seller emphasizes that using the Internet always carries a risk of attacks and unauthorized access.
§14 Personal Data and Privacy
- The administrator of Users’ personal data is Adrian Winiarz Consulting.
- Data is processed for the purposes of: fulfilling Orders, managing Accounts, handling payments, marketing the Seller’s own products (with consent), managing complaints, and meeting tax and accounting obligations.
- The legal basis for data processing stems from, among others, Article 6(1)(b), (c), and (f) of the GDPR and, in the case of consent, Article 6(1)(a).

- Payment data is processed by the Tpay operator under the terms specified in their regulations.
- Users have the right to access, rectify, delete, restrict processing, transfer data, object, and lodge a complaint with the President of the Personal Data Protection Office (UODO).
§15 Cookies and Similar Technologies
- The Platform uses cookies necessary for its operation and — with user consent — also analytical and marketing cookies.

- The User may change cookie settings in their browser or via the consent management panel.
§16 Copyright and Licenses
- All materials (content, recordings, presentations, graphics) made available through the Platform are protected by copyright and other intellectual property rights.
- The purchase of a training product does not constitute a transfer of economic copyright, unless explicitly stated otherwise.
- The User is granted a non-exclusive license for personal use (or internal use in case of a corporate purchase) of the materials, within the scope specified for the product.
- It is prohibited to copy, publicly share, distribute, sell, or publish the materials online without the consent of the Seller or authorized entities.
- Quoting within the limits of fair use, with proper source attribution, is permitted in accordance with the law.
§17 Reviews and Ratings
- Users may leave reviews for purchased training sessions.
The Seller may verify whether a review comes from a person who actually used the given Service (in accordance with regulations implementing the Omnibus Directive).
§18 Dispute Resolution
- In case of a dispute, the Consumer may use out-of-court methods of complaint and redress (ADR), including permanent consumer arbitration courts or mediation through the Trade Inspection.

- In B2B disputes, the court with jurisdiction over the Seller’s registered office will be competent, unless mandatory legal provisions state otherwise.
§19 Changes to the Terms and Conditions
- The Seller may amend the Terms and Conditions for important organizational, legal, or technological reasons (e.g., change in regulations, expansion of Platform functionalities, change of payment provider).
- Users with an Account will be informed of changes at least 14 days in advance (via email or notice within their Account).
- The changes take effect on the date specified in the notice. Orders placed before the changes come into force will be processed under the previous terms, unless the User accepts the new version.
§20 Final Provisions
- In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular: the Civil Code; the Act of 30 May 2014 on Consumer Rights; the Act of 18 July 2002 on the Provision of Electronic Services; the GDPR; the Act of 4 February 1994 on Copyright and Related Rights; and other applicable laws.
- These Terms and Conditions do not exclude or limit any rights of Consumers arising from mandatory provisions of law.
- The language of the agreement is Polish. Any translated versions are for informational purposes only; in the event of discrepancies, the Polish version shall prevail.
- The Terms and Conditions enter into force on the date of their publication on the Platform.
